1 Completion of the accommodation contract
1.1 The booking order - can be granted written, oral or via email - is a short-term accommodation agreement between the Client and "M&S Kommunikation | Messewohnung in Düsseldorf" by the confirmation of the booking by "M&S Kommunikation | Messewohnung in Düsseldorf".
1.2 The booking made by the Client is for all persons listed on the booking. By making a booking the Client contracts on behalf of himself/herself and all those on his/her booking list and represents that he/she has the authority to accept these conditions on behalf of and binding upon all members on his/her booking list.
1.3 Occupation must be limited to a maximum number of persons for the apartment in the available beds of max three only. The maximum occupancy of the apartment shall not be exceeded. As such any over-occupancy is considered to be a serious infringement of the Terms and Conditions and can result in an immediate requirement to vacate the premises, with no refund of monies due, and possible further charges in the event of damage to the facilities caused by excess usage.
1.4 The booking Client is the sole contractor for "M&S Kommunikation | Messewohnung in Düsseldorf". Without prejudice possible or actual responsibility of other in the booking included persons or companies the booking client alone is full extent responsible for payment of the booked and the used the services, for damages and other receivables "M&S Kommunikation | Messewohnung in Düsseldorf" may have from the accommodation contract and the use of the apartment.
1.5 Bookings are accepted on the understanding that the apartment is taken for agreed purposes only and that - excepting babies - the number of people in apartment is limited to that agreed with the booking confirmation. The Client and any friends or family of the Client visiting the apartment while the Client is staying there must adhere to the conditions of the contract. If inviting friends to visit the Client must first seek the permission of "M&S Kommunikation | Messewohnung in Düsseldorf".
2 Reservations
2.1 Non-binding reservations which entitle the booking Client a free withdrawal are only possible as a subject of an explicit agreement with "M&S Kommunikation | Messewohnung in Düsseldorf". If no such agreement was made, a booking on behave of point 1.1 leads to a legally binding contract between the Client and "M&S Kommunikation | Messewohnung in Düsseldorf".
3 Resignation
3.1 In case of withdrawal of the Client "M&S Kommunikation | Messewohnung in Düsseldorf" insist on payment of the agreed price.
3.2 After receiving the booking order "M&S Kommunikation | Messewohnung in Düsseldorf" sends an invoice for the booking via e-mail which is also an input confirmation. If 50 % of the invoice amount have been received on the specified invoice account of "M&S Kommunikation | Messewohnung in Düsseldorf", the booking client gets an acknowledgment of receipt and a booking confirmation for the apartment from "M&S Kommunikation | Messewohnung in Düsseldorf" via e-mail. If the amount isn’t four weeks after the sending of the invoice received to the billing account of "M&S Kommunikation | Messewohnung in Düsseldorf" forfeit the booking option. In case of cancellation of the confirmed booking, this amount of 50% of the invoice amount will be payable in any case.
The rest of the bill is paid by the booking Client also by bank transfer so that the amount is received on the billing account of "M&S Kommunikation | Messewohnung in Düsseldorf" at the latest four weeks before the day of arrival at the apartment. In case of cancellation of the booking less than 28 days before the arrival at the apartment the full amount of invoice amount is due.
3.3From clause 3.2 different rules require explicit written / e-mail confirmation by "M&S Kommunikation | Messewohnung in Düsseldorf".
3.4 The cancellation of bookings should be made in writing / e-mail in the interest of the booking client.
4 Prices / Services
4.1 The stated prices are final and include all obligatory costs and the VAT (currently 19%).
4.2 The minimum booking period is three nights. While a fair the number of official show days at least will be billed.
4.3 The owed services of "M&S Kommunikation | Messewohnung in Düsseldorf" arise solely from the contents of the booking confirmation and the invoice.
4.4 One set of bed linen and towels for each person of the booking list are supplied free of charge in the apartment. For a change during a booking period a fee may be required for these extra services.
5 Payment
5.1 "M&S Kommunikation | Messewohnung in Düsseldorf" requires the payment amount in advance by bank transfer. Credit or debit cards are not accepted.
5.2 Different methods of payment require the prior written agreement with "M&S Kommunikation | Messewohnung in Düsseldorf".
6 Liability of "M&S Kommunikation | Messewohnung in Düsseldorf"
6.1 "M&S Kommunikation | Messewohnung in Düsseldorf" is not liable for property damage, bodily injury, loss of any kind of object in the apartment. The Client or members of his/her party cannot hold "M&S Kommunikation | Messewohnung in Düsseldorf" liable for any personal injury/death howsoever sustained where "M&S Kommunikation | Messewohnung in Düsseldorf" and/or their employees have used reasonable skill and care; and/or where caused by the fault of the person(s) affected or any member(s) of their party (including inadequate supervision of children); and/or where caused by the fault of a third party, and/or where caused by an event that could not have been reasonably foreseen or avoided.
6.2 "M&S Kommunikation | Messewohnung in Düsseldorf" is not liable for malfunctions in connection with services, which are only obtained as external services.
6.3 "M&S Kommunikation | Messewohnung in Düsseldorf" is exclusively liable for errors made by themselves and their agents as well as for any defects of service provision.
7 Liability of the Client
7.1 Provide general security in and around the apartment during the period of the accommodation booking. Close and lock all doors and windows when leaving the apartment during your stay. If keys are lost or misplaced by the client, "M&S Kommunikation | Messewohnung in Düsseldorf" reserves the right to charge a call-out fee for afterhour’s attendances and for key replacements. Unforeseen circumstances after hours may require a locksmith at the Client's expense.
7.2 The Client ensures that he/she and/or all members of the Booking list and/or all guests do not make excessive noise or engage in conduct in or around the apartment that causes annoyance or harm to neighbours. All reports of excessive noise, unruly or threatening behaviour will be reported to the police and may result in eviction from the apartment.
The Client must not use the apartment or allow its use for any dangerous, offensive, noisy, illegal or immoral activities or carry on there any act that may be a nuisance or annoyance to "M&S Kommunikation | Messewohnung in Düsseldorf" or to any neighbours. "M&S Kommunikation | Messewohnung in Düsseldorf" will not tolerate any verbal or physical abuse towards any of its staff or representatives as well as towards neighbours or visitors surround the apartment.
7.3 The Client shall take all reasonable and proper care of the apartment and its furniture, pictures, fittings and effects in or on the apartment and leave them in the same state of repair, condition, cleanliness and tidiness as at the commencement of the rental period. Leave the apartment in a neat and tidy manner - remove all rubbish, bottles, food and personal items. Wash and put away all dishes and re-make all beds. The fee paid at booking does not include dishwashing, the cleaning of ovens, dishwashers, stovetops, refrigerators and/or the removal of food items left there. Any such cleaning will incur an extra charge to the client.
7.4 The Client is required to inform "M&S Kommunikation | Messewohnung in Düsseldorf" of any damage or breakage in or around the apartment promptly so that it can be repaired and replaced for the next client.
7.5 The Client is bound to reimburse "M&S Kommunikation | Messewohnung in Düsseldorf" for replacement, repair or extra cleaning costs where reasonably demanded by "M&S Kommunikation | Messewohnung in Düsseldorf" for damage caused by the Client or any member of the client's booking group or any other person related to the booking.
7.6 The Client must allow "M&S Kommunikation | Messewohnung in Düsseldorf" and/or its agents to enter the apartment to inspect the state of it, on reasonable notice, except in emergency when immediate access must be granted.
8 Complaints
8.1 In case of any complaints, the booking Client should immediately contact "M&S Kommunikation | Messewohnung in Düsseldorf". Complaints which received later than 14 day after the departure of the apartment will not be accepted.
9 Jurisdiction
9.1 The exclusive place of jurisdiction is Kiel.
10 Arrival and departure time
10.1 The apartment is ready for occupation usually from Monday to Friday from 18.00 clock on arrival day - public holidays, weekend Sat-Sun from 12.00 clock. Arrival is possible by 22:00 at the latest. For the key handover a specific date is to agree with "M&S Kommunikation | Messewohnung in Düsseldorf" in advance. On the day of departure, the apartment must be vacated until not later than 10.00 clock.
11. Non-smoking
11.1 All rooms in the apartment are non-smoking rooms. In case of violation at least 500.00 EUR is charged.
12 Pets
12.1 No pets are permitted in the apartment.
13Right of Entry
13.1 As with any apartment, there is a need for ongoing and occasionally unforeseen work. "M&S Kommunikation | Messewohnung in Düsseldorf" and its contractors may enter the apartment at any reasonable time for reasonable cause. This includes the need to undertake inspections and audits necessary to operate the business, the undertaking of unforeseen (internal and external) remedial repairs together with any annual external re-decoration for which access to the inside of the apartment may be required. External windows and doors may be opened during this process.
13.2 "M&S Kommunikation | Messewohnung in Düsseldorf" will give the Client reasonable notice of such requirements, and aims to restrict the working hours of our contractors to between the hours of 09.00 — 17:00. If this is not possible "M&S Kommunikation | Messewohnung in Düsseldorf" will offer reasonable compensation for any foreseeable inconvenience or loss of enjoyment caused on that day.
14 Others
14.1 In the apartment only common household devices are allowed.
14.2 Washing of clothes is not allowed in the apartment for hygienic reasons. If necessary, washing machine and dryer in the shared cellar is available for a fee.
